Terms & Conditions

General

Before booking travel arrangements with Exodus Paths (a DBA of CHEETHAM TRAVEL, LLC, referred to herein as “Exodus Paths” or “we/us”), we require each client (“Client” or “you”) to agree to the following client services agreement (the “Agreement”). Please read this Agreement carefully.


THIS AGREEMENT CREATES A CONTRACTUAL RELATIONSHIP BETWEEN EXODUS PATHS (CHEETHAM TRAVEL, LLC) AND YOU, THE CLIENT, FOR THE VACATION PACKAGE OR TRAVEL SERVICES PROVIDED. AFTER READING THIS ENTIRE AGREEMENT, YOU MUST INDICATE YOUR UNDERSTANDING AND ACCEPTANCE FOR YOUR RESERVATION TO BE COMPLETED.


By signing, electronically accepting, or taking any other affirmative action to engage Exodus Paths—including providing credit card or billing information—you accept and agree to be bound by this Agreement. If you do not agree, do not proceed with any bookings or payments. Any digital or electronic acceptance constitutes full agreement to these terms. This Agreement may be accepted electronically, and such acceptance shall have the same force and effect as a handwritten signature.

Article I.  Exodus Path's Responsibility

Exodus Paths acts solely as an intermediary in arranging travel services and does not own or operate any transportation, accommodations, or other suppliers involved in your trip. All travel arrangements are provided by independent third-party suppliers over whom Exodus Paths has no direct control, and we are not responsible for their acts, omissions, performance, or any resulting issues. We will use reasonable efforts to arrange the services as described, but cannot guarantee supplier performance and are not liable for any loss, injury, delay, or damage arising from supplier actions or external events.



In no event will CHEETHAM TRAVEL be responsible for incidental, consequential or special damage or loss suffered by any person. CHEETHAM TRAVEL’s maximum liability, for any reason whatsoever, will be limited to the amount paid to CHEETHAM TRAVEL for its services.

Article II.  Payment

All payments, including deposits, must be made according to the payment schedule provided by Exodus Paths at the time of booking, and may be accepted via cashier’s check, personal check, or major credit cards (Visa, MasterCard, American Express, Discover). Prices are quoted based on current rates from third-party operators and suppliers, and Exodus Paths reserves the right to adjust prices if those underlying rates increase due to factors beyond our control (such as fuel surcharges, currency fluctuations, or supplier-imposed changes). Any price increase will be communicated to the Client in writing as soon as reasonably possible; the Client may then choose to pay the additional amount to maintain the booking or cancel without penalty (subject to applicable cancellation fees based on timing and non-refundable deposits). Exodus Paths will not make changes without providing written notice and an opportunity to decide.


Cancellation Policy


All cancellations must be submitted in writing (via certified mail, fax, or email) and are effective only upon receipt by Exodus Paths. The following policy applies to all Exodus Paths journeys unless otherwise agreed in writing for a specific booking.


(a) Client Cancellation.


  • 91+ days before departure: Full refund minus a $100–$250 non-refundable administrative fee per person (depending on trip).
  • 90–61 days: 50% of total trip price forfeited.
  • 60–31 days: 75% forfeited.
  • 30 days or less, or no-show: 100% forfeited.


For group bookings (10+ participants, led by a church pastor/executive): We may offer partial credits if the group size decreases, subject to supplier terms. Individual/small-group bookings (fewer than 10) follow the above strictly unless otherwise agreed in writing.


(b) Exodus Paths Cancellation.


Exodus Paths does its best to operate all journeys planned or listed but many operational circumstances and program aspects are outside of our control, and as such, we reserve the right to cancel a program for any reason. Should a program be canceled or inoperative we will inform you as soon as possible about the cancellation. If Exodus Paths cancels for any reason, Client may be given a partial refund, not including the Initial Deposit, at the sole discretion of Exodus Paths based on the circumstances. Exodus Paths is not responsible for additional expenses that may occur as a result of the cancellation, such as airline cancellation fees, visa fees, vaccinations, purchases of clothing or equipment for the canceled program or other expenses. Note that if Exodus Paths alters, modifies, postpones, or reschedules Client’s journey or offers Client a travel credit or partial refund, such action does not constitute a “cancellation” of Client’s journey by Exodus Paths.


Upon cancellation of services, Exodus Paths reserves all rights under this Agreement.


Force Majeure



Exodus Paths shall not be liable for any failure or delay in performance under this Agreement, or for any cancellation, rescheduling, or alteration of travel services, due to events beyond our reasonable control (Force Majeure Events), including but not limited to acts of God, natural disasters, pandemics, epidemics, government orders or restrictions, war, terrorism, civil unrest, strikes, labor disputes, transportation failures, supplier defaults, or other unforeseeable circumstances. In such events, Exodus Paths may, at its sole discretion, offer travel credits, rescheduling options, or partial refunds (excluding non-recoverable deposits/fees paid to third parties). Exodus Paths will notify Clients as soon as practicable and will not be responsible for any additional or consequential expenses incurred by Clients as a result of such events.

Article III.  Client Obligations

Clients are solely responsible for obtaining and maintaining valid passports, visas, entry permits, vaccinations, and all other required travel documents for every destination and transit point on their itinerary, and for complying with all entry, exit, and health requirements of each country involved. Exodus Paths provides general guidance but cannot verify or guarantee requirements, which vary by nationality, destination, and changing regulations; Clients must independently confirm details with official sources such as embassies, consulates, or the CDC. Failure to have proper documentation may result in denied boarding, entry, or additional costs, for which Exodus Paths bears no liability or responsibility. Clients should also research destination-specific risks, including health hazards, weather, political conditions, and safety advisories via resources like travel.state.gov and cdc.gov/travel. By accepting this Agreement, Clients affirm they have reviewed these obligations and accept full responsibility for compliance.


Travel Insurance Recommendation


Exodus Paths strongly recommends purchasing comprehensive travel insurance before booking to protect against trip cancellation/interruption, medical emergencies, evacuation, and other unforeseen events. Coverage may be available through Exodus Paths or third-party providers—please inquire for options that best suit your needs. Exodus Paths is not liable for any losses if adequate insurance is not obtained.

Article IV.  Assumption of Risks & Waivers

You understand and acknowledge that participation in travel and activities arranged by Exodus Paths (a DBA of CHEETHAM TRAVEL, LLC) involves inherent risks and potential exposure to serious injury, illness (including communicable diseases such as COVID-19), property damage, or death. These risks may arise from the negligence of Exodus Paths/CHEETHAM TRAVEL, its owners, officers, directors, agents, employees, contractors, or subcontractors; the negligence or actions of other participants or third parties; foreseeable and unforeseeable causes, including weather, acts of nature, environmental hazards, uneven surfaces, or debris; and the international nature of trips, which may involve greater risks due to political, health, cultural, or geographical factors, including negative interactions with unaffiliated foreign third parties. Specific risks include but are not limited to physical exertion, travel by various means, physical contact with others, severe allergies, animal/insect-borne illnesses, exposure to unfavorable weather, food-related hazards (e.g., sickness, allergic reactions, choking), and other health or safety issues inherent in recreational travel activities. These risks cannot be entirely eliminated, and Exodus Paths has not attempted to minimize or contradict your understanding of them. You confirm that third-party providers cannot always be controlled, and your safety, health, or well-being cannot be guaranteed.


In consideration of the services provided, you voluntarily assume full responsibility for any injuries, damages, or losses suffered by you (or caused by you), whether resulting in whole or in part from negligence (except where prohibited by law). You, for yourself and on behalf of your heirs, personal representatives, assigns, and estates, hereby release, waive, discharge, hold harmless, and agree to indemnify Exodus Paths (CHEETHAM TRAVEL, LLC), its owners, officers, directors, agents, employees, contractors, and subcontractors from any and all claims, actions, demands, losses, liabilities, or damages—including but not limited to bodily injury, property damage, wrongful death, loss of services, lost profits, consequential, exemplary, indirect, or punitive damages—that may arise out of or occur during your travel, vacation package, or related activities. YOU SPECIFICALLY UNDERSTAND AND AGREE THAT THIS RELEASE INCLUDES CLAIMS FOR THE NEGLIGENT ACTS OR OMISSIONS OF EXODUS PATHS/CHEETHAM TRAVEL, ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, OR SUBCONTRACTORS, WHETHER PRESENT OR FUTURE.

Article V.  Dispute Resolution / Arbitration

Any and all disputes and claims between CHEETHAM TRAVEL and Client arising from this Agreement, the Services or any other prior written agreement shall be resolved by consent of the parties, or decided by litigation, unless CHEETHAM TRAVEL shall advise the Client in writing that CHEETHAM TRAVEL elects to have the dispute decided by arbitration prior to any litigation initiated by CHEETHAM TRAVEL, or prior to the filing of an Answer or other responsive pleading in any litigation initiated by the Client. Any such arbitration shall be conducted pursuant to the Federal Arbitration Act, and pursuant to the Comprehensive Arbitration Rules issued by JAMS then in effect, and judgment upon the award may be entered by any court having jurisdiction. Any claim, dispute or other matter in question relating to this Agreement shall be governed by the laws of the state of South Carolina exclusive of its choice of law provisions. Should CHEETHAM TRAVEL elect to litigate any disputes, venue for any litigation between CHEETHAM TRAVEL and Client which relates to or arises out of this Agreement, its breach or the Services will be exclusively in the United States District Court of South Carolina, Greenville Division or a court of competent jurisdiction for Greenville County, South Carolina, with Client expressly consenting to venue and personal jurisdiction in Greenville County, South Carolina and waiving any rights to begin, defend, or remove any such litigation in any other forum or venue.


Last Updated and Amendments


These Terms and Conditions were last updated on January 26, 2026. Exodus Paths reserves the right to update or modify this Agreement at any time. Any changes will be posted on our website (www.exoduspaths.com/terms-and-conditions) (www.exoduspaths.com/terms-and-conditions), and continued use of our services or failure to object within 30 days constitutes acceptance of the updated terms. It is your responsibility to review this Agreement periodically. The most current version will always be available on our website.
